Transparency Rules for Generative AI and Foundation Models

Recognizing this, the AI Act includes specific provisions addressing these advanced systems. The legislation mandates transparency obligations for generative AI models. Operators of these models will need to disclose that content has been generated by AI. This labeling requirement for AI-generated content is intended to help users distinguish between human-created and machine-generated material, mitigating risks like the spread of deepfakes and misinformation.
Furthermore, the Act requires providers of powerful foundation models – the large models upon which many generative AI systems are built – to disclose information about the training data sources used. For violations of some other provisions, fines can be up to €15 million or 3% of global turnover, and for supplying incorrect information, up to €7.5 million or 1.5% of global turnover.
